I am also aware that delivery fee is not included in the session fee and any plans offered. ***	Terms and Conditions: BOOKING: CLIENT is required to book and pay the non-refundable deposit at least a week before the session. PAYMENT SCHEDULE FOR SESSION FEES AND PLANS: A non-refundable deposit of $50 is required at the time of booking. No dates will be held without the deposit. The deposit is applied towards the session fee or plan amount. The remaining balance is due in full at the time of the session. PAYMENT SCHEDULE FOR MINI SESSIONS: A non-refundable deposit of $35 is required at the time of booking. No dates will be held without the deposit. The deposit is applied towards the session fee or plan amount. The remaining balance is due in full at the time of the session. PAYMENT SCHEDULE FOR MATERNITY AND/OR BABY PLANS: A non-refundable deposit of $50 is required at the time of booking. No dates will be held without the deposit. The deposit is applied to the plan amount. Fifty percent (50%) of the plan amount is due in full at the time of the first session. The remaining balance is due at the time of the second session. PAYMENT OPTIONS: The non-refundable deposit of $50 can be paid through credit card, debit card or echeck online or through mailing a check. Fees due at the time of the session can be paid through cash or check. CHECK PAYMENTS: Electronic checks and mailed check payments for the non-refundable deposit have to be received at least ten (10) days before the date of photography to allow for check clearing. RESCHEDULING AND CANCELLATION: To avoid $25.00 rescheduling fee, CLIENT must notify PHOTOGRAPHER at minimum 48 hours before original session date/s and time/s. Reschedule fee, if applicable, has to be paid at least 24 hours before the start of the new session. For last minute rescheduling (less than 3 hours before session), reschedule fee due is $40. Reschedule is allowed for up to 2 times only. PHOTOGRAPHER reserves the right to reschedule the session in the event of an emergency or conflict that may arise, including last minute notifications. In the event the session or any remaining sessions cannot be rescheduled, refund will be full amount paid minus prorated fees of any completed sessions and delivered products. PHOTOGRAPHER shall have no further liability with respect to the Agreement. REFUND TERMS: For one-session fees and plans, no refund available after the completion of the session. For maternity and newborn/baby plans, the 50% of the plan amount due at the time of the first session is non-refundable after completion of the first session. The remaining balance which is due at the time of the second session is non-refundable after completion of the second session. MEANS OF COMMUNICATION: Within less than six (6) hours before the session, PHOTOGRAPHER and CLIENT are to communicate with each other if necessary through mobile phone. NO-SHOW: If the CLIENT is not at the photography location within 15 minutes from the start time of the session and has absolutely not contacted the PHOTOGRAPHER on her mobile phone, it will be considered a no show and PHOTOGRAPHER will totally cancel the session. CLIENT is not obligated to pay the remaining of the session fee. TARDINESS: Last minute reschedule will be considered by PHOTOGRAPHER if the CLIENT notifies PHOTOGRAPHER about being tardy for more than 30 minutes. Last minute reschedule fee of $40 applies. PHOTOGRAPHER will wait for maximum 30 minutes at the location for the CLIENT and/or CLIENT’s family. PHOTOGRAPHER will contact CLIENT on her/his mobile phone in case PHOTOGRAPHER will not be able to make it on time for the session. CLIENT may decide to reschedule if PHOTOGRAPHER will be late for more than 30 minutes. Session will be rescheduled at a mutually agreeable time without any additional charges to the CLIENT. PHOTOGRAPHER will give $40 print credit to the CLIENT if PHOTOGRAPHER is tardy for more than 30 minutes, whether session is rescheduled or resumed at the original date. Should CLIENT decide to completely cancel the session and not reschedule, $50 deposit will be refunded to CLIENT. PHOTOGRAPHER shall have no further liability with respect to the Agreement. BASIC SESSION DETAILS: PHOTOGRAPHER will take photos of the CLIENT or member/s of the CLIENT’s family at the location, date and time agreed upon in this contract. The session fee covers: Photography session on a location within 30 miles from PHOTOGRAPHER's home with zipcode 97007. Session up to 2 hours; can be extended to 3 hours if necessary especially for newborn sessions. Pre-consultation with the photographer via email or phone. For up to 4 people. $10 per additional person. Artistic editing and minor retouching of the 20 to 25 best images taken from the session. Free online gallery for 2 weeks with 25 to 30 proofs. PLANS OR MINI SESSION DETAILS: If you buy a plan, or mini session, plan or mini session details and inclusions will apply. PRINT CREDIT: The session fee of $100 includes the photographer's talent and time only and cannot be credited towards prints or packages. However, receive $50 print credit bonus after a paid order at least $75 within the first week of online gallery posting. This is not applicable for those who purchase plans or mini session. ONLINE VIEWING: Within 2 weeks after the session, an online viewing will be available. All edited images will be presented in colored and a few will also have B&W and/or Sepia versions. PHOTOGRAPHER might present some edited versions under SPECIAL ART with different price range for prints and other products. The CLIENT will have (2) weeks of FREE online gallery and/or ordering. After that, online gallery and ordering will expire to make way for new clients. Once online gallery has expired, there will be a $30 fee to activate online ordering for up to two (2) weeks. Images will be kept by in archive for two years only. DIGITAL FILES: If digital files are purchased, PHOTOGRAPHER will still hold the copyright to all images, unless CLIENT purchases files with full copyright release. PHOTOGRAPHER guarantees that the files provided can produce quality printing up to resolution size of files purchased. However, PHOTOGRAPHER is not liable for any poor quality printing of the files by other photo labs or vendors. Printing results may vary from one photo lab to another. During reproduction or ordering of reproduction of prints and other photo products by the CLIENT using the files, it is the CLIENT's responsibility to make sure that the resolutions of the files provided meet the requirements of the reproduction. The digital files are sold “AS IS”. For special products and prints that require higher resolutions, it is recommended that CLIENT orders directly from PHOTOGRAPHER to ensure quality printing. Some images may not be available in resolution higher than 1610 x 1265 pixels or 11 x 14 resolution. Some cropping along the sides of the images might occur depending on the size of print. PHOTOGRAPHER can only guarantee quality of printing of products or prints ordered through PHOTOGRAPHER. Liability of PHOTOGRAPHER in any unusual event is limited to refund of full amount paid for the digital files. PHOTOGRAPHER shall have no further liability with respect to the Agreement. PHOTOGRAPHER may choose not to sell the digital files of some images including but not limited to "SPECIAL ART" images, or any images with some advance editing applied, for quality control purposes. However, in some instances, PHOTOGRAPHER might sell digital files of those images provided CLIENT purchases print enlargement of those files in size of at least 8 x 10. All images with pure solid background of any color will only be sold if CLIENT purchases print enlargement of those files in size of at least 8 x 10. Most of these images are taken indoors and with the use of backdrops. DIGITAL FILES PACKAGES: All digital images that can be included in packages, whether prepaid or not, are only those taken without the use of pure solid background. Images that can be included in this package will have natural background and without the use of backdrops. All images with pure solid background of any color will only be sold if CLIENT purchases print enlargement of those files in size of at least 8 x 10. Most of these images are taken indoors. COMPLETION SCHEDULE: Prints and other products purchased, together with any free products will be available for delivery based on the following schedule: • Birth Announcements – available for delivery 3 days after order payment receipt and/or receipt of email notifying PHOTOGRAPHER of the photo to be processed and other details of the announcement. • Digital files – available for delivery one (1) week after order payment receipt and/or receipt of email notifying PHOTOGRAPHER of the photos to be processed. • Prints up to size 12 x 18 – available for delivery one (1) week after order payment receipt and/or receipt of email notifying PHOTOGRAPHER of the photos to be printed/processed. • Prints up to size 12 x 18 (with some mounted prints) – available for delivery two (2)) weeks after order payment receipt and/or receipt of email notifying PHOTOGRAPHER of the photos to be printed/processed. • Prints from 16 x 20 to 20 x 30 (mounted only) – available for delivery four (4) weeks after order payment receipt and/or receipt of email notifying PHOTOGRAPHER of the photos to be printed/processed. • Canvas, photo books, story board, and calendars – available for delivery four (4) weeks after order payment receipt and/or receipt of email notifying PHOTOGRAPHER of the photos to be printed/processed. Custom designs and other requests from CLIENTS may lengthen the delivery schedule. Photos are numbered for reference. For check payments, add one (1) week on the schedule. FIRST CLASS USPS MAIL DELIVERY FEES - Birth announcements - up to 25 pieces - $15 - Orders of smalls prints (size 5x7 and smaller) - up to 20 pieces - $15. - Digital files on a CD - $10 Products will be sent to CLIENT's home address. Should the CLIENT request for a different shipping method, any additional expense will be billed to the CLIENT before delivery or mailing. HAND DELIVERY FEE. PHOTOGRAPHER prefers to hand deliver most other orders, especially those with those which include enlargements (size 8x10 and larger) and other special products such as canvas, calendars, etc. unless otherwise agreed upon by both parties. Hand delivery fee is waived for orders amounting to $200 and above. Hand delivery fee costs $20 per delivery within Westside Portland, Beaverton, Aloha, Tigard and Hillsboro . For other locations: delivery is $35 per delivery. Hand delivery fee requires full payment before delivery of the products. PHOTOGRAPHER hand delivers only within 30 miles from zipcode 97007 and only during Tuesday, Friday and Saturday of the week unless otherwise agreed upon. For maternity, newborn and baby plans, delivery fee for all sessions may be waived by PHOTOGRAPHER provided CLIENT agrees to meet PHOTOGRAPHER in a location convenient to PHOTOGRAPHER within 5 miles from zip code 97007. Otherwise, regular hand delivery fee will apply. SHIPPING LIABILITY: PHOTOGRAPHER recommends prints and other special products to be hand delivered. However, items may be shipped to the CLIENT at the CLIENT's expense by a shipping method that allows tracking of the package and with an appropriate amount of insurance, plus $20 flat fee covering the time and travel of PHOTOGRAPHER to the shipping company. Shipping will be based on quote of shipping company. Shipping amount requires full payment before processing of the shipping. PHOTOGRAPHER chooses the shipping company unless the CLIENT expresses personal choice. Liability for loss or damage of any item once they have entered into the custody of the shipping company will no longer rest with PHOTOGRAPHER but will transfer to the shipping company. PHOTOGRAPHER is not liable for any damages incurred during shipping and during handling of the products by the CLIENT after opening the package. If the package is damaged, the CLIENT should not accept the product from the shipping company. RETURNED CHECKS: A $30 charge will be added for each check returned. After this, cash only will be accepted as payment. LEGAL FEES: CLIENT agrees to pay the full cost of any necessary legal fees, or collection fees incurred by PHOTOGRAPHER to enforce this agreement. PAYMENT METHOD AND SCHEDULE: Payment can be done through PayPal online or by mailing a check. All orders, hand delivery fee or shipping amount require full payment at the time of the order and before processing of orders. For check payments, please allow about one (1) week for check to clear before processing of orders. PRICING : Pricing of prints, digital files and other products, including delivery fees is valid from the time that you book your session until two (2) weeks following the posting of your online ordering page. Subsequent pricing of all products and services may change without notice. MODEL RELEASE FORM : The model release form has to be signed together with this contract and is effective from the time of the session. Model release form allows PHOTOGRAPHER to publish and use the images taken during the session as part of her portfolio and for marketing purposes. No personal information about the models will be published. RIGHT OF REFUSAL: PHOTOGRAPHER reserves the right to end the session at any time for any reason should PHOTOGRAPHER deem necessary. PHOTOGRAPHER also reserves the right to refuse a requested location for any reason. PARK FEES: Should the park or location of the CLIENT'S choice has entrance fee, the CLIENT is responsible for the payment of such fees for each individual joining the session, including the PHOTOGRAPHER. SAFETY: Use of any props such as chairs and benches to pose young children is the sole judgment and decision of the CLIENT. Any harm or accident to any individual or children during the session due to the use of such props will not be the responsibility of PHOTOGRAPHER. In addition, any accident resulting from other activities such as running and playing of the CLIENT'S children or other children around the location of the photography, or any other person in the photography location are beyond PHOTOGRAPHER's responsibility. The CLIENT should be able to manage and control their children and other individuals joining the session both for safety purposes and to accomplish the photo assignment. COPYRIGHT: PHOTOGRAPHER and CLIENT agree that at all times PHOTOGRAPHER shall maintain all rights to the images created, and reproductions there from. The photographs produced by PHOTOGRAPHER are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without PHOTOGRAPHER 's explicitly written permission. Digital files are available for purchase with either full copyright release or non-exclusive right to use the files. RIGHT TO EDIT: PHOTOGRAPHER reserves the right to edit the photographs and not to show every photograph taken for any problem such as people have bad expressions. LIMIT OF LIABILITY : In the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond PHOTOGRAPHER's control, PHOTOGRAPHER's liability is limited to the return of all payments received for the session package. LIABILITY RELEASE: CLIENT acknowledges some potential risks whether minor or major, that may occur during the entire time of photography session. Risks may include by way of example and not limitation, any harm that may arise from setting up and operating equipment or property owned, maintained, or controlled by PHOTOGRAPHER on the photography location above. CLIENT hereby waive, releases and discharges forever all claims for damages against PHOTOGRAPHER and its representatives for any and all injuries and / or losses CLIENT and/or any member of the family may sustain during the photography session. CLIENT promises not to sue PHOTOGRAPHER and any of its representatives for any and all liabilities or claims made as a result of CLIENT and/or any family member’s participation in the photography session mentioned above. ACTS OF GOD. PHOTOGRAPHER will not be held liable in the event of fire, strike, casualty, Act of God, or other cause beyond the control of the parties. If cancellation is due to PHOTOGRAPHER's illness, then all deposits made by the CLIENT will be refunded, but PHOTOGRAPHER shall have no further liability with respect to the Agreement. INCLEMENT WEATHER. PHOTOGRAPHER will not be held liable in the event of environmental conditions beyond PHOTOGRAPHER's control and reserves the right to decline photography outdoors in inclement weather. The CLIENT is responsible for alternate locations for any photographic services. Photography will not take place outdoors during inclement weather. PHOTOGRAPHER reserves the sole right to deem the weather suitable or not for photographing the CLIENT's session. All sessions cancelled due to inclement weather at PHOTOGRAPHER's discretion will be rescheduled at a mutually agreeable time without any additional charges to the CLIENT. INHERENT DEFECTS. PHOTOGRAPHER is not liable for damages, including but not limited to delay or omission arising from inherent equipment defects or fault, or other causes beyond its control. Liability in any event is limited to refund of all photographers fees paid. DAMAGE TO EQUIPMENT. In the event any of the PHOTOGRAPHER ' s equipment is damaged or destroyed, either accidentally or intentionally, by the CLIENT, CLIENT's children, guests and attendants, or employees of the CLIENT, the CLIENT is fully responsible for the equipment ' s replacement at current new market prices.
